General Terms and Conditions
We are LDB Consultant Limited. We own and operate www.healthexpress-mart.com (the āWebsiteā or āhealthexpress-martā). Through the Website, we provide online shopping and one-stop delivery services (the āServicesā).
Please read these terms carefully before using the Website. By using the Website or any part of it, you agree to be bound by the following terms and conditions. We may revise these terms and conditions from time to time by updating this page. Revised terms take effect from the date they are posted.
Product Statement
Products sold by us may be Hong Kong authorised stock or parallel imports. The actual source and classification are as stated on each product page. All products are health foods for daily consumption and are not medicines and have no medical efficacy. These products have not been registered under the Pharmacy and Poisons Ordinance or the Chinese Medicine Ordinance. Any claims made in relation to these products have not been evaluated for the purpose of such registration. These products are not intended to diagnose, treat or prevent any disease.
Registration
You must register with us before using the Services or placing an order. By registering, you represent, and we are entitled to rely on that representation, that you are at least 18 years old and have the capacity to enter into a legally binding contract.
When registering, you must:
(i) provide accurate, complete and up-to-date registration information;
(ii) keep your personal username and password secure; and
(iii) authorise us to assume that only you or a person authorised by you will use your username and password to access the Website.
You must notify us immediately of any change to your registered information so that we can contact you effectively.
If we have reasonable grounds to suspect that your registered information is false, inaccurate, outdated or incomplete, we may cancel your order and/or terminate your registration. In such circumstances, you agree not to bring any action or claim against us for compensation.
Orders
When you place an order, the product price is the price shown on the date of the order.
All prices on the Website are stated in Hong Kong dollars.
A text message or email will be sent to the mobile number or email address used for registration to confirm that we have received your order. This message or email does not constitute a commitment to deliver the ordered items.
We reserve the right, at our sole discretion, to reject or cancel an order for any reason, including but not limited to:
1. insufficient stock of the product(s) ordered;
2. inability to arrange delivery to your area; or
3. an incorrect price displayed for one or more products due to human or computer error, or incorrect pricing information supplied by a supplier.
You may notify us to cancel an order at least twenty-four (24) hours before the scheduled delivery time. Cancellation is effective only after we have confirmed it.
Payment
We accept Visa, Mastercard, American Express, FPS and PayMe. All orders are settled in Hong Kong dollars.
We use third-party payment service providers to process online transactions. When placing an order, you agree and accept that, subject to the providerās terms and conditions, your credit card information will be collected, processed and retained by the payment service provider. You agree and accept that you alone are responsible for any loss incurred or arising from a credit card transaction, and we will not be liable for any such loss, whether in whole or in part.
We do not collect or retain your credit card information. If you choose to save your credit card information for express checkout, you agree and accept that it will be encrypted and retained by the third-party payment service provider.
For payments made by Visa, Mastercard, American Express, FPS, PayMe, Apple Pay or Google Pay, the maximum online purchase amount is HK$10,000 per transaction.
*FPS payments are subject to the daily transaction limit of the relevant account.
If we cancel an order for any reason after you have made payment, we will credit an equivalent amount of HEM-Dollar to your account.
We reserve the right to change the online shopping payment methods at any time without prior notice.
Products and prices displayed on the Website are for reference only and are subject to the details applicable at the time of the transaction.
General
We may amend these terms and conditions at any time without prior notice. In the event of a dispute, our decision will be final.
If a Chinese translation of these terms and conditions is provided and there is any inconsistency between the Chinese and English versions, the English version will prevail.
We take privacy seriously. Our Privacy Policy governs our use of any information you provide. By using our Services, you agree that we may collect, store and use your information in accordance with our Privacy Policy. You acknowledge and agree to be bound by the terms of our Privacy Policy.
We may, at our sole discretion and without notice, deny any user access to the Website or any part of it, and may refuse to provide our Services to any user who breaches these terms and conditions.
You may not assign or otherwise deal with any or all of your rights and obligations under these terms and conditions without our prior written consent.
These terms and conditions constitute the entire agreement and understanding between the parties and supersede all prior oral or written agreements, understandings or arrangements relating to their subject matter. Neither party may rely on any agreement, understanding or arrangement not expressly set out in these terms and conditions.
These terms and conditions are governed by the laws in force in Hong Kong. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong. If any part of this agreement is legally unenforceable, that part will take effect to the fullest extent permitted by law and the remaining parts will remain in full force and effect.
You agree to defend, indemnify and hold harmless us, our directors, officers and agents from any claims, proceedings or demands arising from your use or alleged use of the Website or its content, or from your breach of this agreement, including reasonable legal and accounting fees.
Where required, we will charge HK$0.50 for each plastic shopping bag in accordance with Hong Kong law.
Intellectual Property
All intellectual property rights in the content, user content, designs, text, images and other materials on the Website, and in their selection or arrangement, are owned, controlled or licensed by us. Any use without prior written authorisation is strictly prohibited. All trademarks, product names, company names and logos appearing on the Website are our property or the property of their respective owners. We do not grant permission to use any such trademark, get-up, product name, company name, logo or title, and such use may infringe the rights of its owner.
